Our Commitment to Intellectual Property Rights

Machinence Ltd. respects the intellectual property rights of others, and we expect our users to do the same. We prohibit users from uploading, posting or otherwise transmitting on this website or by use of any of our services any materials that violate another party’s intellectual property rights.

It is our policy, in appropriate circumstances and at our discretion, to disable and/or terminate the accounts of users who may repeatedly infringe or violate the copyrights or other intellectual property rights of any party.

1. DMCA and UK Copyright Law Compliance

This Copyright Policy complies with the Digital Millennium Copyright Act (DMCA) of the United States and the Copyright, Designs and Patents Act 1988 of the United Kingdom. We take copyright infringement seriously and respond promptly to valid notices of alleged infringement.

Notice: This policy applies to all content uploaded, posted, or shared through Machinence’s services, including websites, online stores, social media posts, blog content, images, and any other materials created or published using our platform.

2. Notification of Alleged Copyright Infringement

If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please provide our Copyright Agent with the following information:

  1. Signature – An electronic or physical signature of the person authorised to act on behalf of the owner of the copyright or other intellectual property interest.
  2. Description of Copyrighted Work – A description of the copyrighted work or other intellectual property that you claim has been infringed.
  3. Location of Infringing Material – A description of where the material that you claim is infringing is located on the website, with enough detail that we may find it on the website (including specific URLs if possible).
  4. Your Contact Information – Your address, telephone number, and email address.
  5. Good Faith Statement – Your statement that you have a good faith belief that the disputed use is not authorised by the copyright or intellectual property owner, its agent, or the law.
  6. Accuracy Statement (Under Penalty of Perjury) – Your statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorised to act on the copyright or intellectual property owner’s behalf.

Important: Under the DMCA and UK law, you may be held liable for damages (including costs and legal fees) if you make a false or bad faith allegation of copyright infringement. Please ensure your notice is accurate and complete before submitting.

4. Counter-Notification Process

If you believe that content you posted was wrongly removed or disabled in response to a copyright notice, you may file a counter-notification with our Copyright Agent.

4.1 Counter-Notification Requirements:

  • Your physical or electronic signature
  • Identification of the material that was removed or disabled and its location before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the courts of England and Wales if outside the United States)
  • A statement that you will accept service of process from the person who provided the original infringement notification or their agent

What Happens After Filing: Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed content at our discretion.

5. Repeat Infringer Policy

In accordance with the DMCA and UK copyright law, Machinence has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also limit access or terminate accounts of any users who infringe intellectual property rights, whether or not there is repeat infringement. Factors we consider include the number of valid infringement notices received, the severity of the infringement, and whether the user made a good faith effort to comply with copyright law.

6. Your Responsibilities

6.1 Content Ownership

You represent and warrant that you own or have the necessary licences, rights, consents, and permissions to use and authorise Machinence to use all content you upload, create, or publish.

6.2 Third-Party Content

You must not upload, post, or publish:

  • Content that infringes copyright/trademarks/patents
  • Copyrighted media without authorisation
  • Trademarked logos without permission
  • Plagiarised content without attribution

6.3 AI-Generated Content

Whilst our AI tools generate original content, you are responsible for ensuring that any prompts you provide and the resulting content do not infringe third-party rights. AI-generated content should be reviewed and verified before publication.

6.4 Stock Images and Media

If you use stock images, videos, or other media from third-party sources, you must ensure you have the appropriate licence or permission to use them commercially.

7. Our Response Process

7.1 Upon Receipt of Valid Notice

We will:

  • Review the notice for completeness and validity
  • Remove or disable access to the allegedly infringing material promptly (typically within 24-48 hours)
  • Notify the user who posted the content
  • Provide information about filing a counter-notification
  • Document the infringement for repeat infringer policy purposes

7.2 Response Timeline

We aim to respond to all valid copyright notices within 48 hours.

7.3 Restoration of Content

Content will only be restored if a valid counter-notification is received and the original complainant does not file legal action within the required timeframe (typically 10-14 business days).

Warning About False Claims: Under Section 512(f) of the DMCA and applicable UK law, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and legal fees.

8. Machinence’s Intellectual Property

The Machinence platform, including its software, design, code, features, documentation, logos, trademarks, and all other elements, are the exclusive property of Machinence Ltd. Protected elements include:

  • The Machinence name, logo, and branding
  • Software code, algorithms, and architecture
  • User interface designs and layouts
  • Documentation, help articles, and training materials
  • AI models and training data
  • Website templates and design elements

You may not copy, modify, distribute, sell, or lease any part of our Service without express written permission.
